Proposition 45 & 46 Defeated; Health Reform Impact Uncertain

California voters have spoken. Proposition 45 and 46 has been soundly defeated. The measure, which would have given the state’s insurance commissioner ultimate authority over health care premiums for small business and individual health insurance policies, failed.

Proposition 46, which would have raised the limit on medical malpractice damages and required random drug tests for doctors, also failed.

Insurance commissioner Dave Jones was re-elected.

On the national level, Republicans won a majority of seats in the U.S. Senate. The Republicans will now control both the Senate and House of Representatives in Washington, D.C., beginning in 2015. While Kentucky’s Sen. Mitch McConnell is likely to become the new Senate majority leader, and he has vowed to roll back some of the provisions of health care reform, Republicans will not have the 60 votes needed to break a Democratic filibuster, nor will they have the two-thirds majority required to override a veto by President Obama.
